Supreme Court Grants Stay of Duane Buck Execution
Updated: At about 7:40 p.m., the U.S. Supreme Court stayed the scheduled execution of Duane Edward Buck.
Buck was praying when Texas Department of Criminal Justice officials informed him of the news, said spokesman Jason Clark. "He said, 'God is worthy to be praised. God's mercy triumphs over judgment, and I feel good,'" Clark said.
Buck had already had his last meal of fried chicken, salad, french fries, fried fish, jalapeño peppers and apples before state officials received the decision from the high court, Clark said. Buck is now being transferred back to death row ...

1. I can't stand Perry, but the decision is not in his hands. Since Perry is out of the state, it is in Dewhurst's hands.
2. For me, this is a tough call. Nobody denies his guilt. And, I believe having to spend decades locked up in prison is a far greater punishment than the death penalty. So, would I be heartless enough to do that to another human being.

did anyone actually read after the fold? on cross, prosecutors got a witness to admit that Buck was dangerous (and therefore deserving of a death sentence) simply because he was black. is this the precedent you want to set? a man sentenced to die merely because of the color of his skin?

Rick just believes in letting God sort them out...Dewhurst ain't gonna get into this one either....He can't take the chance that one of his opponents will accuse him of "saving a murder". Politics is always more important than the possibility of an injustice anyway.

The fact of the matter is that one one of the witnesses was a dumbass and brought race into it. First he stated that Buck is not a future danger and then he said that he's a potential threat because he's Black. So apparently he's not a future danger but then he is a future danger because he's Black. I guess maybe the psychologist figures that if Buck changes his skin color then he won't be a future danger.

Wow. Never did I once remotely entertain the thought of the US Supreme Court intervening. This surprise gives me hope that one day, Texas will have the strength to admit to mistakes in the criminal justice system and work to correct, and prevent more mistakes in the future.

The one state in the Union where executions should be forbidden is Texas because of the way it is abused. The great state of Texas even opposed introducing DNA evidence in at least one case to prove a (Black) man innocent of murder. You would think that the prosecutor would want to insure that the people they execute are NOT guilty and would NOT want to execute an innocent person. Not in Texas and not if the defendant is Black.

The fact IS that every single one of you bloodthirsty people would want a FAIR and UNTAINTED trial for yourself or someone you love. I praise this decision to stay the execution, and I pray that Buck will get a FAIR new sentencing trial, and I pray that he'll get LWP rather than execution.

@Lorre, I see what you're saying, and yes, his guilt is not in question. But regardless of your position on the death penalty every deserves a fair and untainted trial with good representation. This will not buy him a new trial, it MIGHT buy him a new sentencing trial. He may still get death, but everyone deserves even the sentencing part of the process to be free from racial bias. We'd all want that for our loved ones, yes?

Mickey, the defendants' guilt or innocence isn't the issue here. The issue is the way the prosecution made it's case. How would you feel if you or one of your family members were the one on trial?
